Civil Litigation
While we resolutely and fearlessly undertake litigation on behalf of our clients, we do so upon full and extensive advice to our clients. It is often said that litigation is never the best way to resolve a dispute and should be a last resort. This is perhaps not the reality as, once there is a dispute and parties are sufficiently and or irreparably aggrieved and entrenched in their corners, that dispute may already be on its way to litigation, albeit not formally, but certainly eventually for some form of resolution. The aforementioned refrain against litigation is likely due to the fact that it is such an expensive, time consuming, emotionally charged and absorbing undertaking and one that quite often does not result in a 100% satisfactory recovery or resolution.
Litigation is often fraught with uncertainty, sometimes with surprises, often with histrionics and, certainly, with expenses. It is for all these reasons that we advise our client to only commence litigation if they possess “the stomach for it” and are prepared for the duration or open to accepting legal advice as to when to settle matters.
